Terms of Sale
2 Orders
2.1 We shall not be deemed to have accepted your order for products unless it has been confirmed.
2.2 From time to time we may have to make changes to the advertised product to:-
2.2.1 Ensure it conforms with any applicable safety or other statutory requirements or
2.2.2 To reflect changes in manufacturers specifications.
2.3 We will agree the price of products as per our order confirmation to you. These shall reflect out current quoted or published prices.
2.4 The cost of delivery may be at additional cost to the products quoted or published on our current price list.
2.5 The cost of fitting or installing equipment is only included if specifically agreed in writing by you and us.
2.6 We keep a very large stock of products. In the unlikely event that a listed product is out of stock, we will advise you and
2.6.1 Give you a realistic assessment of when the item will be dispatched
2.6.2 Offer you a chance of alternative suitable product or
2.6.3 Offer a refund (if already paid for the product).
2.7 Payment of products will be taken prior to dispatch
2.8 Prices are inclusive of VAT (Registration number GB 125 2969 05).
3 Terms of Payment
3.1 Subject to any specially agreed terms in writing between you and us, we shall be entitled to invoice you and collect payment prior to the dispatch of products.
3.2 If you fail to make any payments on the date due, without prejudice to any other right or remedy we have, we can:-
3.2.1 Cancel this agreement between you and us
3.2.2 Suspend any further deliveries to you and/or
3.2.3 Charge you interest (both before and after any judgement) on the unpaid amount of 2% above the base lending rate of Barclays Bank Plc. as published from time to time. Interest is charged on a per annum basis, calculated daily.
4 Right to cancel
4.1 Under the Consumer Protection (Distance Selling) Regulations you have the right to cancel an order and return the products to us, subject to the following conditions:-
4.1.1 We must be informed by you in writing of the cancellation within 7 calendar days from receipt of the product
4.1.2 Where services are to be provided we will only accept cancellation if, within 7 days, we have received written notification to cancel AND the service hasn’t commenced
4.1.3 The products must be unused and returned in the original condition and original undamaged packaging
4.1.4 You have to pay the cost of returning the products to us
4.1.5 We can only refund the cost of the products. Postal costs incurred by us to deliver the products to you will not be refunded
4.1.6 Where delivery was “free”, 15% of the product purchase price will be deducted from our refund to you to cover our postal costs
4.1.7 Certain types of goods are not covered under these regulations such as books, DVD’s, custom made or customer specification goods, perishables and livestock
4.1.8 You will have to return the products within 7 days from the date of cancellation
4.1.9 If a product is not in a re-saleable condition then we will not be able to offer you a refund. We will send the product back to you and you will have to incur the cost of any return delivery
4.1.10 If the goods are damaged in transit we reserve the right to refuse a refund and it will be your responsibility to seek compensation from the carrier
4.1.11 Once we have received the product and satisfied ourselves that you complied with the above conditions we will make an immediate refund.
5 Warranties & Replacements
5.1 Subject to the clauses below, products offered by us, where new, are sold with the benefit of and subject to the manufacturers terms applicable to warranty and guarantees.
5.2 No liability is accepted for:-
5.2.1 Any default resulting from fair wear and tear
5.2.2 Accidental or wilful damage
5.2.3 Negligence
5.2.4 Failure to follow manufacturers instructions
5.2.5 Misuse, alteration or repair of the product without manufacturer approval.
5.3 There shall be no liability under any such warranty or guarantee if the total price for the product has not been paid.
5.4 Subject to clauses 5.1 and 5.5, if a valid warranty claim is made, we will replace or repair at our discretion the product free of charge. After the warranty period we may make a charge for either of these remedies.
5.5 We shall (at our or the manufacturers option) have the right to fulfil our obligations under clause 5.4 by refunding you the price you paid (or a proportionate part thereof, depending on age and condition). That will be the extent of our liability to you.
5.6 Items found to be damaged on delivery must be reported within 24 hours of receipt. Damaged goods will need to be returned to us before a replacement is dispatched.
5.7 Products returned subject to clause 5.6 must be sent back via standard Royal Mail or Parcel Force and then full postage charges will be reimbursed once the product has been received by us.
5.8 Clauses 5.6 and 5.7 do not apply to Aquariums, Tanks and Associated Stands. We regret to advise that once you have accepted delivery of these goods we can not offer any refunds.
